The demand to migrate to Australia has always been high(compared to the number of people leaving) which in itself tells you the story about the appeal of this fantastic country, though as pointed out in Migration Agents important to the health of Queensland, the Queensland Government needs to increase it’s intake of migrants above the 2009 levels. As the demand is so high, the Australian Immigration Department is known for it’s tough policing of the immigration system and in recent times has moved towards the encouragement of trade skills and Business skills and away from general family migration.
That’s not to say that it doesn’t have policy in place to cater for quotas of family migration and refugees, but if you have a skill it will stand you in great stead in your migration application.
The Visa system is made up of many subclasses, each have their own conditions and criteria, and should you apply through the wrong subclass or not meet the conditions of the subclass in which you apply, you will be rejected and lose your application fee. If a visa application is rejected and the application involved an Australian sponsor, you are able to appeal though an Australian Independent Review Tribunal, where a further fee is payable. There are many cases of such tribunals overturning the original decision resulting in a succesful application and a refund of the tribunal fee. There have also been cases where an appeal has been taken to the High Court, in this instance lawyers fees would be payable but again precedant of success leaves this avenue open to some.
Outside Australia there is no regulation on who can offer advice and assistance to migrate to Australia, as well as no regulation on who can charge for the service. In Australia however there is very strong Government regulation, including a Code of Conduct. Registration is administered by MARA(Migration Agents Registration Authority), not being registered with MARA and offering Migration advice can lead to a jail sentence, hence establishing the system’s integrity. Being Registered with MARA, includes a demonstration of sound knowledge on the migration system and the requirement to keep that knowledge constantly updated.
